Campaign for Immigration Due Process Celebrates Reintroduction of the SHIELD Act by Rep. Robert Garcia

$100 Million Grant Program Would Equip States and Localities to Defend Immigrant Communities and Keep Families Together

WASHINGTON, DC – Today, Representative Robert Garcia (D-CA) reintroduced the Securing Help for Immigrants through Education and Legal Defense (SHIELD) Act of 2025, a bill that would establish a $100 million federal grant program to strengthen legal representation for immigrants and uphold due process. The bill is co-sponsored by Congresswoman Delia Ramirez (D-IL) along with Congresswoman Norma Torres (D-CA), lead sponsor of the Fairness to Freedom Act, a complementary measure that would establish a right to legal representation for all people facing deportation.

The SHIELD Act would create a renewable four-year competitive grant program to support programs in states and localities that defend their communities from deportation. Funding could be used to recruit, train, and retain legal services staff to meet the urgent needs of immigrant communities facing detention and deportation.

“The unconstitutional deportations of Kilmar Abrego Garcia and Andry José Hernández Romero by the Trump Administration have reminded us of the immediate need to protect the right to due process in our immigration system,” said Congressman Robert Garcia. “These tragic cases are a harsh reminder of what happens when people are denied basic rights and reinforces the need for proper legal representation. The SHIELD Act is a critical step to ensuring that our legal system protects the due process of those who are most vulnerable, providing them with the legal resources they need and working toward creating a more humane and just immigration system in our country.”

Shayna Kessler, director of the Advancing Universal Representation initiative at the Vera Institute of Justice, said: “Legal service providers and their clients—including children and babies—have borne the brunt of the Trump administration’s cruel attacks on due process. The termination of federal funding for immigration legal services programs like the Unaccompanied Children Program, the National Qualified Representative Program serving people with mental health needs, and the Legal Orientation Program for people in detention have depleted the immigration legal infrastructure. The SHIELD Act would help rebuild and expand that infrastructure, promoting fairness and due process for people facing detention and removal. We urge Congress to support this commonsense solution to safeguard due process and keep families together.”

Fairness to Freedom: The Campaign for Universal Representation was launched by the Vera Institute of Justice and the National Partnership for New Americans in April 2022 with a coalition of over 200 organizations and legal service providers. The campaign’s goal is to support the passage of the Fairness to Freedom Act to establish a federal right to representation for all immigrants facing deportation.
