The magistrate court commissioners in Orleans Parish are not elected, yet, according to the New Orleans CityBusiness, for the past 36 years they have presided over trials, issued verdicts, and imposed sentences—all of which is forbidden by state law. In December, the Orleans Public Defenders' office issued a formal accusation of the commissioners for violating state law to the Louisana Supreme Court, and the Orleans District Attorney's office concurred with the accusation. The court has not yet set a date to consider the matter.
